  1. CONDITIONS OF ACCESS AND USE OF THIS WEBSITE

Access to the website, contents and information. Access to this website is the sole responsibility of the users, and implies acceptance and knowledge of the legal warnings, conditions and terms of use contained therein. MIVI SALUD reserves the right to make, at any time, as many changes and modifications it deems appropriate and deems necessary for the website without prior notice.

  1. MOBILE MESSAGING SERVICE CONDITIONS (SMS)

5.1 ACCEPTANCE OF SERVICE

When subscribing to MIVI Salud’s mobile messaging service, the user will receive a registration confirmation message.

By means of this subscription, the user expressly agrees to receive text messages (SMS) of an informative and/or commercial nature relating to MIVI Salud’s services, products, campaigns and news.

Messages may be sent by automated systems to the cell phone number provided by the user during the subscription process or to any other number subsequently designated by the user.

The consent to receive commercial communications by SMS is voluntary and does not constitute a necessary condition for the contracting of any service.

5.2 FREQUENCY AND CHARACTERISTICS OF MESSAGES

The frequency of messages may vary depending on user activity, current campaigns or interactions with MIVI Salud.

MIVI Salud reserves the right to modify the sending frequency, as well as the short number, telephone number or alphanumeric identifier from which messages are sent.

5.3 COSTS

MIVI Salud does not charge for sending messages; however, the usual message and data rates established by the user’s mobile operator may apply.

The mobile operator is not responsible for delayed or undelivered messages.

5.4 CANCELLATION OF SERVICE

The user may unsubscribe at any time:

  • Sending a message with the word “STOP” as a reply to any of the messages received.
  • By following the unsubscribe link included in the message, when it exists.
  • Or requesting it by e-mail to: ijvaldeolmillos@mivisalud.com

Once the unsubscription has been processed, the user will receive a confirmation message and will not receive any further communications, unless he/she expressly re-registers.

5.5 APPLICATIONS FOR ASSISTANCE

For any query related to the messaging service, the user can send an e-mail to ijvaldeolmillos@mivisalud.com or reply with the word “HELP” to any of the messages received, if applicable.

5.6 CHANGE OF NUMBER

The user agrees to notify any change of cell phone number associated with the service.

Before transferring your number to another person, you must send a message with the word “STOP” or unsubscribe by the means indicated above.

5.7 DATA PROTECTION

The personal data provided will be processed in accordance with Regulation (EU) 2016/679, Organic Law 3/2018 and Law 34/2002.

The legal basis for the processing shall be the consent of the data subject for the sending of electronic commercial communications. The user may withdraw his consent at any time without affecting the lawfulness of the previous processing.

5.8 MODIFICATIONS

  1. LEGISLATION AND JURISDICTION

The relationship between MIVI Salud and the user shall be governed by the Spanish legislation in force.

In case of controversy or conflict that may arise from the access or use of the website, when the user is a consumer, the Courts and Tribunals of the consumer’s domicile will be competent, in accordance with the provisions of the regulations for the defense of consumers and users.

In cases where the user is not a consumer, the parties may submit to the Courts and Tribunals of Malaga, expressly waiving any other jurisdiction that may correspond to them.
